Kroger settlement: who qualifies, how much and how to claim
Kroger prescription settlement: a $17 million fund for insured customers at Kroger pharmacies. Claim by Dec. 21, 2026; proof only for big claims.

Yes, the Kroger settlement is open for claims until Dec. 21, 2026. If you paid anything out of pocket for a prescription at a Kroger-owned pharmacy using insurance between Dec. 9, 2018 and Aug. 23, 2026, you can claim a pro rata share of the $17,000,000 fund, and you need documents only if your estimated spending is $8,000 or more. The administrator can still ask for proof later.
No per-person amount has been announced, and the court has not given final approval yet. Owed's Kroger settlement page keeps the claim link and deadline in one place.
What the Kroger prescription settlement is about
The case is Kirkbride et al. v. The Kroger Co., No. 2:21-cv-00022, in federal court in the Southern District of Ohio. It centers on Kroger's Rx Savings Club, a paid membership program that gives members lower prices on prescription drugs.
When a pharmacy bills your insurer, it reports a "usual and customary" (U&C) price for the drug. The plaintiffs say Kroger kept its lower Savings Club prices out of that figure, which they argue led insured customers to overpay. Kroger denies wrongdoing and says club prices, which go only to members who pay a fee and meet other terms, aren't its "usual" or "customary" prices. The court has not decided who is right.
Kroger agreed to pay $17,000,000 to settle. After the court approves attorneys' fees, expenses, service awards and administration costs, what remains goes to people who file valid claims.
Who qualifies for the Kroger settlement
The class covers anyone in the U.S. or its territories who paid in whole or in part for a prescription from Kroger using insurance between Dec. 9, 2018 and Aug. 23, 2026. The definition doesn't ask whether you joined the Savings Club. What counts is what you paid out of pocket, such as a copay or coinsurance, not what your insurer paid. Prescriptions you paid for entirely without insurance don't count.
"Kroger" here is wider than the Kroger name on the door. The plan counts the chain's other pharmacy banners too: Baker's, City Market, Dillons, Food 4 Less, Foods Co, Fred Meyer, Fry's, Gerbes, Jay C Food Store, King Soopers, Mariano's, Metro Market, Pay-Less Super Markets, Pick'n Save, QFC, Ralphs, Ruler and Smith's Food and Drug.
You are out if you opted out, are a Kroger officer or director, or already sued Kroger, filed arbitration or joined a settlement over Savings Club usual-and-customary pricing outside this case.
How much you could get from the Kroger settlement
There is no per-person estimate. Your share is your counted claim divided by everyone's counted claims, times the net fund left after fees and costs. On Oct. 6, 2026, class counsel asked the court for fees of one-third of the fund ($5,666,666.66), costs of $610,325.71 and $5,000 service awards for each of the two named plaintiffs. The judge can award less.
The claim form asks for an estimate of your out-of-pocket spending in brackets, not an exact total. Under the proposed plan each bracket is counted at a set value, shown below, so pick the one that honestly fits you. You certify your answers are true, and the form warns that false information can bring sanctions. The plan still needs court approval. For why pro rata checks tend to be modest, see why settlement checks are so small.
| Your estimated out-of-pocket spending at Kroger | Counted in the plan as | Documents |
|---|---|---|
| $1–$500 | $500 | Not required up front |
| $501–$1,000 | $1,000 | Not required up front |
| $1,001–$4,000 | $4,000 | Not required up front |
| $4,001–$7,999 | $7,999 | Not required up front |
| $8,000 or more | The amount your documents show | Required |
How to file a Kroger settlement claim
File on the official site, KrogerSavingsClubSettlement.com, which Angeion Group runs, or mail a paper form. Filing directly is free. If you are unsure what a notice number is, read what a claim ID or notice ID is, and if you need to gather paperwork, see what counts as proof of purchase.
- Confirm you filled insured prescriptions at a Kroger-family pharmacy between Dec. 9, 2018 and Aug. 23, 2026.
- Estimate what you paid out of pocket across that whole period. Pharmacy receipts, your insurer's statements and card or bank statements can help you ballpark it.
- Find your Notice ID and confirmation code if you got a notice. You can still file without them, but you may be asked for documents.
- Go to KrogerSavingsClubSettlement.com and choose Submit Claim, or print the claim form and mail it to Kroger Savings Club Litigation Settlement, Attn: Claim Forms, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103.
- Check your spending bracket. If it is $8,000 or more, upload or attach itemized receipts, statements or other records.
- Choose how to be paid. Digital options include PayPal, Venmo, Zelle, ACH and virtual prepaid cards, and you can ask for a paper check instead.
- Sign and submit by Dec. 21, 2026. Mailed forms need a postmark by that date. Keep your receipt or confirmation.

Is the Kroger settlement legit?
Yes. On June 24, 2026, the federal judge preliminarily approved the deal and appointed Angeion Group to run notice and claims. The official site is KrogerSavingsClubSettlement.com, and the notice lists (888) 535-4262 for questions. If an Angeion email or postcard lands in your inbox, our guide to Angeion Group notices explains how to confirm it is real.
A genuine claim never charges a fee or asks for your bank login or card number. Type the site address yourself rather than tapping a link in an unexpected text, and ignore anyone who promises a specific payout.
What happens after you file
The administrator reviews your claim and may contact you for documents. The fairness hearing is set for Jan. 11, 2027. If the judge approves the deal and no appeal holds it up, the initial distribution is due within 120 days after the Effective Date, and an appeal could take several years. Payments go out digitally unless you ask for a check, and checks must be cashed within 180 days. See how settlement payments are sent and how long checks take.
Owed can tell you whether you qualify for this and other open settlements, open the official claim form and remind you before each deadline, but you submit the claim yourself. Owed Pro is $2 for the first week, then $49 per year — one flat membership. Owed never takes a percentage of any payout. Filing directly with the administrator is free. Start with the eligibility quiz, browse the settlements directory, or open the Kroger entry for the deadline.
This guide is general information, not legal advice. The court and the administrator decide who qualifies and how much each person receives.
Glossary
- Usual and customary (U&C) price
- The regular price a pharmacy reports to insurers for a drug. The lawsuit argues Kroger's reported U&C prices left out its lower Savings Club prices.
- Pro rata
- A split of a fixed pot in proportion to each person's counted claim. More valid claims mean smaller shares.
- Net settlement fund
- The $17,000,000 minus court-approved fees, expenses, service awards and administration costs. This is what claimants share.
- Fairness hearing
- The court date when the judge decides whether to give final approval. Here it is set for Jan. 11, 2027.
- Opt out
- Asking to leave the class so you keep the right to sue Kroger yourself. You get no payment if you do, and the date here is Oct. 22, 2026.
