A proposed class action alleges FedEx billed customers for import duties on shipments that were duty-free, plus brokerage fees for customs processing the complaint says was never required.

FedEx acts as customs broker and importer of record on consumer shipments, paying duties to U.S. Customs and then billing the recipient. The complaint alleges it charged duties on goods carrying a “Free” rate, and added clearance fees for entries that would not have been needed.

FedEx has separately sued for a refund of those duties from the government. The complaint alleges it has not committed to passing any refund back to the customers who paid. The allegations are unproven and no settlement exists.
