Definition

Bankruptcy unclaimed funds are payments from a bankruptcy case that were never collected and are held by the federal court for the person owed.

What it means

Bankruptcy unclaimed funds are money from a bankruptcy case that was owed to someone, such as a creditor, but never collected. A federal bankruptcy court holds the money for the rightful owner. The US Courts list common causes: an incorrect address, an uncashed distribution check, or the death of the intended recipient.

The process is set by law. In many cases, 90 days after the final distribution the trustee stops payment on checks still uncashed and pays the leftover money into the court. After five years, the court deposits unclaimed money in the US Treasury, but a claimant can still petition the court for payment. The US Courts say unclaimed funds may be claimed at any time by an owner, successor or other claimant who proves a right to them.

You can search the US Bankruptcy Unclaimed Funds Locator, then contact the court that holds the funds to learn its claim process.

What it means for you

If a company that owed you money went bankrupt, or you once had a Chapter 13 plan, it is worth a check. Search the national locator by name, then contact the clerk's office of the bankruptcy court that holds the money. Expect to give the case number and to prove who you are, or that you inherited the right to the money. Some paid finders offer to claim for you, but you can contact the court yourself. Be wary of anyone who demands money upfront or contacts you out of the blue.

Example

Say a retailer went through Chapter 7 bankruptcy years ago and the trustee mailed you a $140 payment as a creditor. The check went to your old address and was never cashed, so the court now holds the money. You search the locator, find your name, call the clerk's office for the court's steps and apply with your ID and the case number.
