Kelly Benefits data breach settlement: up to $5,000, due Dec 28
Kelly Benefits data breach settlement: who qualifies, the up to $5,000 loss claim, the estimated $50 and $100 payments, and how to file by Dec 28, 2026.

The Kelly Benefits data breach settlement is open until December 28, 2026, and it pays up to $5,000 for documented losses or an estimated $50 with no proof. A $5 million fund covers people in the U.S. whose private information was compromised in the December 12 to December 17, 2024 breach. A California address on December 12, 2024 adds an estimated $100, and everyone can claim three years of credit monitoring. The $50 and $100 figures rise or fall with the number of claims. File on the official settlement site, using the Class Member ID from your notice.
What the Kelly Benefits data breach settlement is about
Kelly Benefits (formally Kelly & Associates Insurance Group, Inc.) works with employers and insurance carriers, so many people in this class never dealt with the company directly. It says it learned of suspicious activity on or about December 12, 2024 and found unauthorized access from December 12 to December 17, 2024, during which certain files were copied. Its review, finished March 3, 2025, found names, Social Security numbers, tax ID numbers, dates of birth, medical and health insurance information and financial account information.
Plaintiffs sued in federal court in Maryland, and the first case was filed on April 22, 2025. They allege negligence, breach of contract and unjust enrichment, among other claims. Kelly Benefits denies any wrongdoing. The judge preliminarily approved the settlement on August 28, 2026. For how breach settlements usually pay, see our data breach settlement guide.
Who qualifies for the Kelly Benefits settlement
The class is everyone living in the United States whose private information was compromised in this breach between December 12 and December 17, 2024. In practice, the settlement is aimed at people who were notified that their information may have been exposed; the postcard notice tells recipients that Kelly Benefits' records identify them as class members. If you received a notice about this breach, look on it for your Class Member ID.
Kelly Benefits and related parties, the judge and court staff, and anyone who validly opts out are excluded. The court documents we read don't state a total class size. If you're unsure whether you're covered, call the administrator at (833) 453-3640. Our guide to who is eligible for a class action settlement covers the basics.
How much you could get
There are four benefits, and you can claim more than one. After court-approved fees, costs and service awards come out, the fund pays in a set order: credit monitoring, then documented losses, then the California payment, and finally the pro rata cash payment. Class counsel will ask for up to a third of the fund, $1,666,666, plus costs. If claims for the first three benefits use up the money, amounts are cut proportionally and no pro rata cash payments go out, so treat the $50 and $100 figures as estimates.
Documented losses can include credit monitoring you paid for between December 12, 2024 and December 28, 2026, unreimbursed fraud or identity theft losses, and bank fees, long-distance calls, postage and local mileage tied to the breach. You can't be reimbursed twice for the same expense. The credit monitoring covers one bureau, adds dark web monitoring and identity recovery help, and includes identity theft insurance up to $1,000,000.
| Benefit | Amount | Documents needed? |
|---|---|---|
| Documented monetary losses | Up to $5,000 per person | Yes: statements, invoices, receipts or similar; a personal statement alone isn't enough |
| Pro rata cash payment | Estimated $50 | No; a signed claim is enough |
| California statutory payment | Estimated $100 | No; you need a California address on December 12, 2024 |
| Credit monitoring | 3 years, single bureau | No; the activation code comes after final approval |
How to file the Kelly Benefits settlement claim
Filing costs nothing, and you submit it yourself on the settlement site run by the court-appointed administrator, Kroll Settlement Administration. One claim can cover several benefits, but each has its own proof rules, so gather any statements or receipts first. For how these ID codes work in general, see claim ID vs. notice ID.
- Find your notice, a postcard or email that carries your Class Member ID.
- Go to KellyBenefitsSettlement.com and press Submit Claim. The online form signs you in with the Class Member ID from your notice. Type the web address yourself.
- Pick your benefits: the pro rata cash payment, credit monitoring, the California payment if it applies, and documented losses if you have them.
- For documented losses, attach statements, invoices, phone records, screenshots or receipts, and sign under penalty of perjury. Skip anything already reimbursed.
- Choose electronic payment when filing online. The postcard's tear-off claim form is paid by check and covers only the pro rata, California and credit monitoring benefits; documented losses or electronic payment need the online or full claim form.
- No notice or lost ID? Use the site's Contact Us page or call (833) 453-3640. The full paper claim form is on the site's Documents page.
- To mail a paper claim, send it to In re: Kelly Benefits Data Breach Litigation, c/o Kroll Settlement Administration LLC, P.O. Box 5324, New York, NY 10150-5324, postmarked by December 28, 2026.
Key dates for the Kelly Benefits settlement

To keep that right you must opt out by mail, postmarked by November 27, 2026, which also means no benefits. Read how to opt out of a class action settlement before you do. Is the Kelly Benefits settlement legit?
Yes. It's a federal court case, and the judge named Kroll Settlement Administration as administrator. The official site is KellyBenefitsSettlement.com, which describes itself as the only authorized website for the case; the administrator's number is (833) 453-3640. The class lawyers, Raina Borrelli of Strauss Borrelli PLLC and James Pizzirusso of Hausfeld LLP, are paid from the fund if the court approves, and you aren't billed for them.
Breach victims get plenty of phishing. A real class claim never charges a fee to file, so don't pay anyone to claim for you or to unlock a payment, and use only the official address. Our guide to spotting settlement scams lists more warning signs.
What happens after you file
The judge decides at the January 12, 2027 hearing whether to approve the settlement and the lawyers' fees. Money waits for that approval and the end of any appeals. After that, the settlement agreement says valid claims are paid within 45 days after the Effective Date, or within 21 days after the claim is approved, whichever is later, by check or electronically. For typical waits, see how long a settlement check takes. Leftover money goes to a nonprofit, not back to Kelly Benefits.
Owed can keep the dates straight: it finds settlements you may qualify for, explains each one in plain English, opens the official claim form, reminds you before deadlines and tracks your claim to payout, while you submit the claim yourself. Owed Pro is $2 for the first week, then $49 per year — one flat membership. Owed never takes a percentage of any payout. You can check what you qualify for or browse the open settlements directory.
This is general information, not legal advice. Owed isn't a law firm or a settlement administrator; the court and the administrator decide who qualifies and what each person gets.
